www.the-mea.co.uk is a site operated by The Middle East Association (MEA). The MEA is a private company limited by guarantee and registered in England and Wales under company number 00685178 with its registered office at Bury House, 33 Bury Street, London, SW1Y 6AX.
You have reached the MEA website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern the MEA’s relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.
1. THE MIDDLE EAST ASSOCIATION – SERVICE
The Service is an online application, containing a wide variety of information and data provided by the MEA and/or posted on the Website by users of the Service (‘content’).
2. MIDDLE EAST ASSOCIATION – MEMBERS’ REGISTRATION
2.1 To take advantage of the full Service, users must sign up as MEA Members. By registering you confirm that all information required in the registration process will be supplied and that this is accurate, and that you will update the information as necessary to ensure that it remains accurate.
2.2 Information supplied in the registration process, as well as other information provided to the MEA during your use of the service is governed by the MEA’s privacy policy.
2.3 Members of the MEA are issued with a password to sign in. The password is to enable any individual from the Member company to sign in as an MEA Member under their particular company name.
2.4 Each Member Organisation should have a key point of contact within their organisation for their MEA Membership. This individual will hold the password, and can pass it onto their colleagues where necessary.
2.5 Members are responsible for maintaining the confidentiality of their password and you are recommended to change the password on a regular basis.
2.6 Members must not disclose your password to anyone who is not an employee of the MEA or their own organisation.
2.7 If Members learn of any unauthorised use of your account or password, they must notify the MEA immediately.
2.8 If, for any reason, individuals are able to log in as an MEA Member when their Membership is no longer valid, and subsequently aims to sign up to MEA events at Members’ rates, then the MEA reserves the right to demand that the correct difference is paid before they attend the event.
2.9 It is the responsibility of MEA Members to ensure that their Membership is renewed on the right date. The MEA will do its best to assist this process by sending email reminders regarding renewal of their Membership approaching this date.
2.10 Those signing up for Membership must select the correct level of Membership corresponding to their organisation, as described on the page. The MEA reserves the right to ensure any mistakes regarding incorrect options chosen are rectified at the soonest possible
moment. The MEA also reserves to right to exclude organisations who deliberately choose the wrong level of Membership.
3. ONLINE BOOKINGS
3.1 When booking to attend events MEA Members will only benefit from Members’ rates if they have logged in as Members.
3.2 It is the responsibility of the individual booking the event to ensure that they have the correct username and password. If necessary, this can be found out from the MEA or from the key point of contact (as per 2.4, above).
3.3 The MEA reserves the right to select delegates to ensure a successful event.
4. EVENT BOOKING CANCELLATION POLICY
4.1 All fees are payable in advance of the event. Should you be unable to attend an event, a substitute is welcome at no extra charge. The MEA appreciates being informed as soon as possible about a substitute, although accepts that this is not always possible,
4.2 Guests may be refused admission to MEA events if payment is not received prior to the event.
4.3 The MEA regrets that it is unable to refund any cancellations made within 48 hours of an event, unless otherwise stated.
4.4 Please contact jacqui@the-mea.co.uk and sarah@the-mea.co.uk with any cancellation notice, or call 020 7839 2137. All cancellations must be confirmed in writing, even if details have been given by phone.
4.5 If you find yourself unable to attend on the day of the event itself, please contact the MEA on the above to ensure that we can make the necessary administration changes on the day.
5. CONTENT ON THE WEBSITE
5.1 You acknowledge that the MEA is not responsible for, does not pre-screen, control, endorse or verify the Content posted to the Service or available through the Service, and that it makes no guarantee regarding the reliability, accuracy, legitimacy or quality of any such Content. You agree that you will bear the entire risk of reliance on the accuracy, validity or legitimacy of any Content.
5.2 The MEA shall have the right (but not the obligation) to access any Membership user contents or other part of the Website and remove or restrict access to any Content on the Service in its sole discretion and without notice or compensation.
5.3 The MEA may preserve or disclose any Content if it reasonable believes this is required by law or in the good faith belief that such preservation or disclosure is reasonably necessary to protect the rights, property or personal safety of the MEA, its users and the public.
6. MATERIAL SUBMITTED BY YOU
6.1 By communicating with the Website and by submitting information and data (for example when signing up as Members or Registering for an event), you confirm that you:
(a) have all necessary legal rights, including, without limitation, intellectual property rights to the material you send to the Website and that no contractual or legal rights of any third party will be infringed or adversely affected;
(b) take full responsibility for all material you send to the Website;
(c) will not send any unlawful, confidential, defamatory, obscene, threatening, sexually or racially offensive, abusive, harmful or otherwise objectionable material; and
(d) will ensure that nothing sent by you contains software viruses, Trojan horses or any other computer code, files or programs which may interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications.
6.2 If you commit or permit a breach of any of the above, you will keep the MEA fully indemnified against all liabilities and claims arising out of your actions and the MEA may, at its sole discretion terminate your password, account (or any part of it) or ability to use the Service, and remove and discard any Content within the Service.
6.3 You grant the MEA the world-wide, royalty free and non-exclusive license to reproduce, modify, adapt, distribute and publish any material that you submit, for the purposes of display on the Website.
7. USER COMMENTS
7.1 In using the Service to create or make accessible an online discussion (via user comments on particular blogposts or articles), you agree to use your best efforts to ensure that individuals posting Content to the board comply with the requirements of Section 6 of this Agreement, and you agree to take action to remove or disable access to any Content on the board that violates any of the provisions of Paragraph 6 of this Agreement.
7.2 User comments may be moderated by the MEA.
8. USER DISPUTES
You are solely responsible for your interactions with other users of the Service. The MEA reserves the right, but has no obligation, to monitor disputes between you and other users of the Service.
9. The MEA COPYRIGHT & NO RESALE OF SERVICE OR CONTENT
9.1 MEA is the owner or the licensee of all intellectual property rights in the website and in the material and Content published on it. No rights are given to you in respect of the same except as specifically stated in this Agreement.
9.2 You must not use any part of the materials or Content on our website for commercial purposes. If you breach this paragraph 9.2 then your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
9.3 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way for your personal reference and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
9.4 Our status (and that of any identified contributors) as the authors of material of our site must always be acknowledged.
9.5 The word mark MLLP is a UK registered trade mark of MEA with registration number 2482043.
10. RULES REGARDING SERVICE
10.1 You agree that the MEA may establish, in its sole discretion, any rules concerning use of the Service, including, for example, the maximum number of messages a user may post to a given board or the Service in a given day, the number of days that posted messages will be available, or the maximum size of a given post.
10.2 You acknowledge that the MEA has the right to change these rules at any time, in its sole discretion, with or without notice. You and those authorized by you will comply with all rules in force.
11. MODIFICATION AND TERMINATION OF SERVICE
11.1 The MEA reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part of it) with or without notice. You agree that the MEA shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service. You are expected to check this page from time to time to take notice of any changes we make to this Agreement as its terms are binding on you.
11.2 You agree that the MEA, in its sole discretion, may terminate your password, account (or any part of it) or ability to use the Service, and remove and discard any Content within the Service, without having to give any reason. You agree that any termination of your access to the Service may be immediate and without prior notice. You further agree that the MEA shall not be liable to you or any third-party for any termination of your use or ability to access the Service.
11.3 The MEA reserves the right to take any action it deems necessary with respect to user account if we have reason to believe it may cause us to lose the services of our ISP or suppliers.
12. LINKS TO OTHER WEB SITES
Links to other websites exist for the anticipated benefit of users. You agree that the MEA has no control over any such links, does not endorse and has no responsibility for any aspect of those other websites, their content or products, and the MEA accepts no responsibility for any loss or damage that may arise from your use of them.
13. DISCLAIMER OF WARRANTIES
You agree that:
(a) your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis.
(b) The MEA gives no warranties and expressly disclaims all implied warranties to the fullest extent permitted by law including, but not limited to, the implied warranties of merchantability, fitness for purpose and non-infringement;
(c) The MEA gives no warranty that (i) the Service will meet your requirements, or be uninterrupted, timely, secure, or error-free, or (ii) that any Content or advice or information that may be obtained from the use of the Service will be accurate or reliable; and
(d) Any material downloaded or otherwise obtained through the use of the Service is obtained and used at your sole risk and discretion and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
14. OUR LIABILITY
The material and Content displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we hereby expressly exclude:
(a) All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity;
(b) Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including without limitation liability for:
i Loss of income or revenue;
ii Loss of business;
iii Loss of profit or contracts;
iv Loss of data;
v Loss of goodwill;
vi Wasted management or office time; and for any other loss or damage of any kind however arising and whether caused by tort, breach of contract or otherwise.
This does not affect our liability for death or personal injury arising from our negligence, nor
our liability for fraudulent misrepresentation or any other liability which cannot be excluded
or limited under applicable law.
15. INDEMNITY
You agree to indemnify and hold the MEA, and its members, affiliates, officers, agents, employees, and contractors harmless from any losses, damages, cost and expenses, including reasonable legal fees, suffered or incurred as a result of any claim, demand or proceedings by any third party arising out or in connection with any action or inaction on the part of yourself or anyone for whom you are responsible including, but not limited to, any Content you submit to the Service, your use of the Service, your connection to the Service, your violation of the law, this Agreement or the rights of any third party.
16. NOTICES
Notices to you may be given via email, regular mail or airmail. Notice sent by email will be deemed received on the date of transmission. Notice sent by regular mail will be deemed received two working days after posting in the UK, five working days if sent by airmail. The MEA may also give notice of changes to this Agreement or the Service by displaying notices or links to notices on the Website.
17. GOVERNING LAW & DISPUTES
17.1 This Agreement and your relationship with the MEA shall be governed by the laws of England. You and the MEA agree to submit to the exclusive jurisdiction of the English courts.
17.2 The MEA retains the right to bring proceedings against you for your breach of these conditions and terms in your country of residence or in any other relevant country.
18. VIRUSES, HACKING AND OTHER OFFENCES
You must not misuse our website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our website, the server on which it is stored, or any server, computer or database connected to our site.
By breaching this provision you would commit a criminal offence under the Computer Misuse Act 1990 which we will report to the relevant law enforcement authorities. In the event of such a breach your right to use our site will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may affect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it or on any website linked to it.
19. AMENDMENT TO AGREEMENT
The MEA may amend this Agreement at any time by posting the amended terms on our site at www.the-mea.co.uk. All amendments shall automatically be effective on the date specified in the notice or, if none, 30 days after they are initially posted on our site. Your use of the Service following the effective date of any modifications shall constitute your binding acceptance of those modifications. This Agreement may not be otherwise amended except in a writing signed by an officer of the MEA. This Agreement was last modified on 11/11/2011.
20. GENERAL
20.1 This Agreement constitutes the entire agreement between you and the MEA with respect to the Service and supersedes all prior agreements and understandings between you and the MEA concerning its subject matter.
20.2 The MEA’s failure to enforce any provision of this Agreement will not be construed as a waiver of any provision or right.
20.3 In the event that any provision of this Agreement is held in whole or in part to be invalid or unenforceable, the invalid or unenforceable portion will be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the provisions will remain in full force and effect.
